We distribute and provide our software, contents or materials and services on several services provided by third party, we develop our software contents or materials and our services in Japan and our service operations are operated in Japan.
PLEASE READ CAREFULLY BECAUSE THIS POLICY IS STATED RELATING TO YOUR INFORMATION AND DATA, ESPECIALLY REFERING TO THE DATA TRANSFER, WHEN YOU RESIDE OUTSIDE JAPAN AND YOU USE, BROWSE OR REVIEW OUR SOFTWARE, CONTENTS OR MATERIALS AND SERVICES.
1. Privacy Statement
We collect and use your information and data specified in Section 2 stored in our software and services or through our business activities. We recognize the significance of your personal information and your data and are committed to the following.
1.1 We have established our own policy in handling information concerning your personal information (“Personal Information”) and your data (“Data”), and are committed to protect your Personal Information and Data.
1.2 When we need to collect your Personal Information and Data from you, we will notify you of the purpose of collection, and collect such Personal Information and Data only to the extent necessary expressly specified.
1.3 We will use your Personal Information and Data only within the scope of the purpose of collection, manage such Personal Information and Data in an appropriate manner, and in no way disclose or provide such Personal Information and such Data to a third party except under exceptional circumstances expressly specified.
1.4 We will keep your Personal Information and Data accurate and up-to-date and take measures to protect your Personal Information and Data from unauthorized access, loss, corruption, falsification or divulgation.
1.5 When we contract the processing of Personal Information and Data to a third party, we will bind such party to the non-disclosure or non-redistribution obligation by way of contract, and will oblige such party to implement appropriate management of Personal Information and Data.
1.6 We will keep any Personal Information and Data received from an outsourcer under strict control, and use such Personal Information and Data within the scope stipulated in the contract with such outsourcer.
1.7 We will promptly deal with your request for confirmation, correction or otherwise of your Personal Information and Data in a reasonable scope subject to your notice given to our contact address for you.
1.8 We will abide by any law, ordinance, rule or regulation applicable to any Personal Information and Data under our control, and will maintain and improve each of the above commitments as well as the prevention and protection activities.
2. Personal Information and Data
In our software and services, our response to your inquiries, or our user communications by questionnaires, we may collect or acquire your Personal Information and Data as follows:
(1) Email address and password you register for “MetaMoJi ID”. When create a new account for “MetaMoJi ID”, you may register your email address and password for your account. We use such email address and password to confirm the identity of the user and prevent any unauthorized use of our software or services. And we use such email address to contact you for the user support and the user communications or provide you our product or service information. In no event shall we check your password and no password will be given to any person (including you) under any circumstances even when you desire to confirm your password you register. In the case you do not create your “MetaMoJi ID” and do not register your email address and password, you may acknowledge that you may not use our service “MetaMoJi Cloud”, “MetaMoJi Gold service”, “mazec Plus” and you may not use some features or functions included in our software.
(2) Your name and company name. Our software “YACHO” and “GEMBA Note” require you to register your name and your company name additionally to create your “MetaMoJi ID” and to use “YACHO” and “GEMBA Note” for authentication of “YACHO” and “GEMBA Note”.
If you do not register your name and company name, you may not use “YACHO” and “GEMBA Note”, but in the case you registration is not genuine and correct, you may use “YACHO” and “GEMBA Note”.
(3) Other information you register. When create a new account of “MetaMoJi ID”, you may register your nick-name of your account for using our service. While the registration is optional, if you decide not to register such information, you may not be able to use all or parts of our software or services.
(4) Your nome, email address and password you register for “eYACHO for Business”, “GEMBA Note for Business”, “MetaMoJi Share for Business” and “MetaMoJi ClassRoom”. You may register your name, your email address and password as a account of the entity which you belong to. We use such information to confirm the identity of the user and prevent any unauthorized use of our software or services. But we may not use such information to contact you.
(5) Device information you use. When you use your device to use our software or services, your device provides device information that you registered and stored in your device name, device type you use and setting information of language and time zone in order to confirm the identity of the user and prevent any unauthorized use of our software or services, to provide support service, and to improve our service better. Such device information varies by platform. We also use such information to calculate anonymous, aggregate statistics on the number of unique devices using our software or services.
(6) Information of your software operation. We collect the information of your software operation and interruption or error information on our software and send such information to our server computers. We use such information only to analyze our software problems or defects and to fix such problems or defects and improve our software.
(7) Our software and services you use. “MetaMoJi Cloud”, “MetaMoJi Gold Service” and “mazec Plus” collect the information of the software of our product you use, your operation information on our services, your license and setting information of our services,data size of your use on our services, your network information and access information to access our services. to confirm the identity of the user and provide our software or services. We use such information only to provide and keep our services steady and stable, to confirm the identity of the user of our services, to confirm the license condition of our services, to find, inspect and improve problems on our services and to improve our services to provide better services.
Furthermore, “MetaMoJi Note Lite (iOS version)” and “Palu (iOS version and Android Version)” includes “Google Mobile Ads SDKs for AdMob” provided by Google, Inc. and “MetaMoJi Note Lite (Windows version)” and “MetaMoJi Note for Surface”, “MetaMoJi Note for VAIO”, “MetaMoJi Note for NEC Personal Computer” includes “Microsoft Advertising SDK for Windows 8.1 XAML” provided by Microsoft Corporation to display advertisements. Such advertisements are selected and displayed by the services provided such SDK provider, such SDK provider collects and calculates your click data of advertisements, and we uses the data received form such advertisement services only for marketing purpose to provide our software and services.
(8) Data on Services. You may store the file data on “MetaMoJi Cloud” created by using our software. We store your file data on our services secure, but we shall not review, browse, check or analyze your file data. You may register your calendar data and share with such calendar data with the third party designated by you on our software “Palu”. In such case, the data shared by you is transferred to our server computers but such does not include Personal Information or information identifying a person. We store your information only to provide our software features or functions but not to review, browse, check or analyze your calendar data.
(9) Information Registered with Third-Party Services. In our software or services, there may be functions that integrate with services provided by third parties. In connection with the use of such functions, a third party may explicitly request that you register your information. In such cases, your information will be handled by the third party, and we will not obtain the information registered by you from such third party.
(10) Website. On our website, we collect website log information such as your access log and your operation log on our website. And cookies are enabled on our website. We use cookies for the usage and convenience for your browsing to identify the computer browsing the website, specifying the browser software and versions, your operation and request on the website, and IP address to access websites, But cookies do not include your personal information. You may disable cookies on your browser, you may acknowledge that some website shall not be displayed or work properly.
In addition, we use Google's service “Google Analytics” for website log collection, recording and analysis. Please check the Google page, for information and data collected, recorded, and analyzed by “Google Analytics”.
Information and data collected, recorded, and analyzed does not include information that identifies a specific individual.
The information and data collected, recorded, and analyzed by “Google Analytics” is managed by Google and is subject to Google's privacy policy. You also agree to Google's privacy policy.
Such collection, recording, and analysis of information and data on our website is limited to cases when you have given your consent for using cookies. If you do not consent to the use of cookies, information and data will not be collected, recorded or analyzed using cookies.
(11)Your inquiries. If you make inquiries about our software or services, we acquire your inquiries to examine problems reported from you and to provide an appropriate response to those inquiries.
(12)Questionnaire data. When you answer our questionnaire, we acquire your questionnaire data such as the information specified in our questionnaire relating to the usage of our software or services.
We use your questionnaire data to improve the Service or develop new features of the Service, new our software or services. To answer our questionnaire is your option.
3.Purpose of use of your Personal Information and Data
We acquire personal information in legally and fairly process and use it within the scope of the “Purposes of Use” set forth in the table below. If a purpose of use arises that is not included within the scope of the “Purposes of Use,” we will use the personal information only after obtaining the data subject’s consent regarding such purpose of use.

Except as setting to share your data with the person designated by you, or in the special case specified in section 8, we shall not share or disclose your Personal Information or Data to the third party. Nick name is displayed on our bulletin board services or message services for another users identification.
You may store the file data on our software installed on your computer, export the data by exchanging the data, sharing the data with the third party, and sending the data to the software or services provided by third parties by using the software function.
5. Deletion of the Data
We may delete the data on “MetaMoJi Cloud” created and stored by you at your own discretion by using the functions of the software which you sign in to the “MetaMoJi Cloud”. If you desire to delete account of “MetaMoJi Cloud” or delete registered information, please contact us separately specified.
6. Data Protection
Data on our system of “MetaMoJi Cloud” and data communication on “MetaMoJi Cloud” is encrypted and we make reasonable effort to develop our service and database systems for “MetaMoJi Cloud” to protect our system from security accidents, incidents and Attacks. Furthermore, we made rules and regulations for our system operation process of “MetaMoJi Cloud” to avoid human error accidents completely or in high probability in logical and we observe such rules and regulations.
7. Security Measures for Personal Information
We implement appropriate security control measures from organizational, personnel, physical, and technical perspectives with respect to the handling of personal information as set forth below.
(1) Organizational Security Management Measures
We establish and operate rules and regulations regarding the handling of personal information, including handling methods, responsible persons, personnel in charge, and their respective responsibilities, for each stage such as acquisition, use, storage, provision, deletion, and disposal. In addition, we conduct regular audits of the status of the handling of personal information.
(2) Personnel Security Management Measures
We provide regular training to our employees regarding the handling of personal information.
(3) Physical Security Management Measures
In areas where personal information is handled, we manage employees’ entry to and exit from such areas and implement measures to prevent unauthorized persons from accessing personal information. We also establish security rules for the handling of business equipment, electronic media, and documents in order to prevent theft, loss, or similar incidents, and we implement encryption for business-use personal computers.
(4) Technical Security Management Measures
We implement access controls to limit the scope of personal information and personal information databases that each authorized person is permitted to handle.
(5) Understanding of the External Environment
In cases where personal information handled by us is stored in a foreign country, we shall implement appropriate security control measures after understanding the relevant legal systems regarding the protection of personal information in such foreign countries.
8. Data Transfer
Our “MetaMoJi Cloud” is developed on “AWS” provided by Amazon Web Services, Inc. and we develop our website and other services on the servers “CPI” provided by KDDI Web Communications Inc. located in Japan.
We store all Personal Information and Data on our systems of our services located in Japan and USA. You may acknowledge and agree that all Personal Information is transferred to Japan or USA except as otherwise agreed. Some jurisdictions do not allow transferring personal information of residents. If you may not agree or accept your Personal Information and Data transfer, you shall stop our services or you shall not use our services.
If you use our software and services in EU area, you acknowledge that your Personal Information and profile data on “MetaMoJi Cloud” is transferred to the system developed and working on the ASW located in Japan and your Data other than preceding your Personal Information and profile data on “MetaMoJi Cloud” is transferred to the system on the ASW located in USA. When we provide support services to “MetaMoJi Cloud”, we may refer to Personal Information and Data in the case of necessity of such support. The other Personal Information and Data is transferred to the servers located in Japan.
9. Provision of your Personal Information and Data
We may provide your Personal Information and Data to third parties in the following cases:
(1)When we have your explicit consent.
(2)When the disclosure of personal information is permitted by applicable laws or regulations.
(3)When a judicial order or the like obliges us to disclose the Personal Information.
(4) When the business of us is succeeded by another entity by way of a merger, corporate separation, transfer of business or otherwise.
(5) When we consign our activities as sending newsletters or so to other entities, in which case the Personal Information is covered by the terms of a non-disclosure agreement.
Except specified above, we may not provide your Personal Information and Data.
10. Joint Use of Personal Data
We may jointly use personal data with third parties only when necessary. In such cases, we will clearly notify the data subjects of the required information in accordance with applicable laws and regulations.11. Trust to our partner
To the extent we consider necessary to achieve the intended purpose concerning the purpose specified in Section 3 of this Privacy Policy, we may trust Personal Information and Data, in whole or in part, to our partner. Our websites and e-mail newsletters may include links to external websites. You are solely responsible for your registration of your personal information on such external websites and we are not responsible for your registration and personal information.
13.Input Data
We shall not collect your input data typed with our software “mazec” and handwriting shortcuts entered into our software “mazec” without your prior consent.
14.Regarding Requests for Disclosure of Personal Information
When we receive a request from you for notification of the purpose of use, disclosure (including records of provision to third parties), correction, addition or deletion of content, suspension of use, deletion, or suspension of provision to third parties (hereinafter referred to as “disclosure and related requests”), we will review the relevant personal information and respond to you as promptly as possible. A copy of a document verifying the representative’s name and current address, such as a driver’s license, health insurance card, or passport.
For an authorized representative:
1) Power of Attorney (attached to the Request Form for Disclosure of Personal Information)

15. Voluntary Provision of Personal Information
